HOMEFIELD ONSITE ENVIRONMENTAL

Residential Sludge Removal Pump Assurance Plan — Service Agreement

This Pump Assurance Plan Service Agreement (“Agreement”) is entered into by and between Homefield Onsite Environmental, operating through its authorized local franchisee identified below (“Homefield,” “we,” “us,” or “our”), and the customer identified below (“Customer,” “you,” or “your”), for the property identified below (the “Property”).

1. Plan Options & Pricing

Customer selects one of the following plans, the terms of which are incorporated into this Agreement:

Plan Feature both include priority scheduling and one no cost emergency pumping between services.

Enrollment Fee (covers first pump-out)


Conventional Care Plan

$425.00, due at signing Monthly Fee $20.00 / month

Scheduled Pump-Out Interval

Every 66 months (5.5 years)


Aerobic Care Plan

$450.00, due at signing.  $22.00/month  scheduled pump-out intervals every 48 months (4 years) 


In the event your intervals need to increase we will provide a prorated price.


Note: Interval and pricing are set by Homefield based on system type (aerobic treatment unit vs. conventional/gravity system) and may be adjusted at renewal for systems requiring more frequent service due to site conditions, usage, or regulatory requirement.

Eligibility — Residential 500/600 GPD Systems Only: This Agreement and the pricing above apply exclusively to residential onsite sewage facilities (OSSF) rated at 500 or 600 gallons per day (GPD). Larger residential systems and commercial/institutional systems may require more frequent pumping and greater volume of sludge removal, and will incur an additional fee determined by Homefield based on system size, capacity, and required pumping frequency. Homefield will provide a custom written quote for any system falling outside this 500/600 GPD residential scope prior to enrollment or service.

2. Scope of Services — Sludge Removal Only

Homefield will remove accumulated sludge from the Customer’s onsite sewage facility (OSSF) at the interval specified in the selected Plan.

Service is limited to sludge removal. Homefield does not guarantee, and is not obligated to perform, complete removal of all liquids/effluent from the tank at each visit, as complete fluid removal is not always necessary or appropriate for proper system function.

Homefield will provide a written service report with photographs documenting the condition of the system and the sludge removed at each and every service visit. Customer is responsible for retaining these records; Homefield also retains copies as described in Section 10.

3. Priority Service

Plan members receive Priority Service, meaning Homefield will schedule the member’s service request in the first available time slot and, where necessary, will reschedule or move non-priority (non-contract) service calls to accommodate a Plan member’s request.

Priority Service applies to scheduling order only and does not waive or shorten any lead time required for parts, permits, weather, or site access.

4. Military & First Responder Discount

Active-duty military, honorably discharged/retired military, and current active first responders (law enforcement, fire, EMS/paramedic) are eligible for the Military & First Responder Discount of [Discount Amount/Percentage] off the enrollment fee.

To qualify, Customer must present, at the time of enrollment, one of the following: (a) a valid military retirement/veteran identification card, (b) proof of current active-duty status (military ID or orders), or (c) proof of current first-responder badge/department identification.

The discount applies to the enrollment fee only unless otherwise stated in writing by Homefield, and cannot be combined with other enrollment discounts or promotions unless expressly approved.

5. Emergency Service

Each Plan includes one (1) free emergency pump-out call per contract term. “Emergency” is strictly defined as a true system emergency, including but not limited to sewage backup into the home, surface breakout/discharge, alarm indicating system failure, or similar conditions posing an immediate health, safety, or property risk.

“Emergency” does NOT include, and Homefield reserves the right to deny or reschedule as a standard (non-emergency, chargeable) service call, requests such as: Customer simply wants the system pumped early, Customer is preparing to sell the property, or other non-urgent convenience requests.

Any request Homefield determines, in its reasonable judgment, not to meet the definition of a true emergency will be billed at Homefield’s then-current standard service rate.

6. Access, Depth, Riser & Excavation Requirements

This Agreement's pricing covers systems with tank access no deeper than six (6) inches below grade. Systems with access deeper than six (6) inches may incur additional excavation/location charges, quoted and disclosed prior to work being performed.

Any system with tank access one (1) foot or greater below grade will be required to have risers installed and brought to grade to allow convenient, safe access for future service. Homefield will offer Customer a fair, disclosed price to install the required riser(s) at the time of the Customer’s first scheduled pump-out under this Agreement.

Customer's continued enrollment in the Plan is conditioned on allowing riser installation where required under this Section; Homefield may decline to perform further pump-outs on non-compliant access points until risers are installed.

Homefield is in no way liable for damage to buried utilities (including but not limited to gas, electric, water, irrigation, cable, or data lines) located within ten (10) feet of the tank(s) that occurs during excavation, tank access, or tank-locating activities. Customer is responsible for disclosing known utility locations and, where required, arranging utility locate services prior to Homefield's arrival.

If Homefield must locate the tank(s), and the tank(s) are not located within the first ten (10) minutes of on-site search time, an additional camera and/or locator fee will apply, quoted and disclosed to Customer before further locating work continues.

Homefield is not responsible for damage to aerobic treatment system components (including but not limited to air lines, electrical/power lines, or control wiring) that run over or across the portion of the tank used for pumping access. Such components installed without proper risers or protective conduit over the pump-access area are considered improperly installed for service-access purposes, and Homefield bears no liability for resulting damage during normal, ordinary pumping operations.

Current State of Texas OSSF rules require all tank lid access ports to be brought to grade. Customer acknowledges that under prior rule versions, minimum requirements (including for conventional systems) allowed access ports to be within six (6) inches of grade or above grade. Homefield's depth-based pricing and riser requirements in this Section apply regardless of the rule version in effect at the time the system was originally installed.

7. Payment Terms & Contract Status

The enrollment fee is due at signing. The monthly fee is due on the same calendar date each month for the life of the Agreement, by the payment method authorized by Customer.

If a monthly payment is not made when due and the account is not brought current within Homefield’s standard grace period, this Agreement is immediately void. Upon voiding, Customer forfeits all further services, credits, and benefits accrued under the Plan (including any banked interval toward the next scheduled pump-out) and must re-enroll and begin a new Plan term, including a new enrollment fee, to resume service.

Homefield reserves the right to apply a returned-payment or late fee consistent with its standard published rates.

8. Early Cancellation (Within First 12 Months)

If Customer enrolls in a Plan and cancels service within the first twelve (12) months of the Effective Date, Customer will be invoiced for the difference between the discounted Plan enrollment fee paid and Homefield’s normal, standard one-time cost of pumping in effect at the time service was performed, plus any collection costs, fees, and reasonable attorney’s fees incurred by Homefield in recovering amounts owed.

This provision survives cancellation, non-payment voiding under Section 7, and termination of this Agreement for any reason within the first 12 months.

9. Ongoing Plan Purpose & Home Sale / Pre-Paid Option

This Plan is intended as an ongoing, multi-year service relationship providing Customer peace of mind through a recurring sludge removal contract, routine inspection, and documented service reporting, which may assist in demonstrating system maintenance history and can support property value at time of resale.

Customers who wish to use this Plan specifically to provide a pre-purchase inspection/maintenance record and transferable peace-of-mind benefit to a prospective homebuyer must pay the full twelve (12) months of Plan fees plus the enrollment fee up front, in full, at the time of enrollment. Homefield will retain and provide detailed service records to support the transaction as described in Section 10.

10. Records

Homefield maintains detailed service records, reports, and photographs for each Property under an active Plan for use by Customer throughout the term of this Agreement, including for maintenance history, resale, or regulatory purposes. Records are provided as a courtesy and do not constitute a certification, inspection report, or warranty of the system’s overall condition beyond the sludge removal service performed.

11. Limitation of Liability — Property Access

Homefield is not responsible for damage to surface improvements (including but not limited to driveways, walkways, patios, sod, flowerbeds, sprinkler/irrigation lines, fencing, or decorative hardscaping) that must be accessed, disturbed, or crossed by Homefield equipment or personnel in order to reasonably perform sludge removal services.

Homefield is not responsible for incidental damage to ornamental items or landscaping features located near the tank, riser, or access point that may be damaged during the normal, ordinary course of performing sludge removal services.

Nothing in this Section limits Homefield’s responsibility for damage caused by gross negligence or willful misconduct.

12. Additional Disclosures

Additional terms, disclosures, and policies applicable to this Agreement are published and incorporated by reference at www.texasseptic.com. Customer acknowledges responsibility for reviewing these additional disclosures.

13. General Provisions

Governing Law: This Agreement is governed by the laws of the State of Texas and is subject to applicable TCEQ Chapter 285 OSSF Rules and Regulations.

Entire Agreement: This Agreement, together with the disclosures referenced in Section 12, constitutes the entire agreement between the parties regarding the subject matter herein and supersedes any prior oral or written representations.

Assignment: Homefield may assign this Agreement to another licensed Homefield franchisee or successor servicing the Property's territory without Customer consent, provided service terms remain unchanged.

Severability: If any provision of this Agreement is held unenforceable, the remaining provisions remain in full force and effect.
